iAmErika Unique Coded Design


My website is unique as CSS controls the border of the image frames.  I decided using code for styling because it is underused on the internet.  A lot of templates used in CMS do not use all the features of CSS.  The styling gives the frame an embossed look at the top and bottom.  



iAmErika.com was redesigned with a responsive HTML5 template.  This is to allow scaling for different platforms like a mobile phone or a tablet.  Cascading Style Sheets (CSS) are used in every page and control the look and feel of the web site.   

All illustrations and photographs are original and copyrighted.  There are some free stock images on the website and those that were purchased. 

The stylized logo illustration was designed by a contractor and it has been trademarked with the USPTO.  The trademark is classified for web services and photography.  The transparent favicon features the first letter in the logo. 

The overall effect is that the website is simple and fast to load.  Validation shows that the errors are minimal.  Keep watching the website as it develops!

Sexual Harassment Steps

There are two forms of sexual harassment:

Quid pro quo or this for that, occurs when some kind of sexual act is asked for or required in exchange for something else.

Hostile work environment is persistent dirty jokes or offensive comments.

First find something you can use in that situation. Think of about at least three ideas, and be ready to think on your feet. If you try something out and it doesn't work you have not made the situation any worse.  You can try something else. And something else after that.

1. Clearly communicate your desire for the behavior to stop.

2. Do all you can to make a record of the instances.

3. Get emotional support from friends, family, or a therapist.

4. Seek resolution and put complaints on record through whatever channels are available to you, such as the State Appeals Board.

Facebook Fortunes Fall

In July 2011 I wrote an article in my blog titled Exposing a Facebook Failure  outlining the flaws of fake company accounts.   In August 2012, I wrote another article Facebook Fake, Google Real; Social Networth about the lack of value in the social network Facebook. 

Lots of suckers believed Facebook had the most valuable information on a social network.   Also, the people trying to make money from Facebook's data are going to be disappointed too.   Google on the other hand is steadily increasing in stock market value.  It may have something to do with "like" enforcing principles of "like" integrity and honesty.   :)

Infact informed consent has been an issue with Facebook for many years, as demonstrated in the legal courts with the following testimony.

The words "Sponsored Story" do not appear at all in the Terms of Use/Statement of Rights and Responsibilities, and the entire topic of permission to use the name profile, and picture in advertising is relegated to two sentences buried in the middle of a 7-page document. The user is told that they can use the Privacy Settings to limit how their name and picture will be used with advertising, but the user is not allowed to actually see that Privacy Settings page until they have signed up and thereby accepted all the terms. This is hardly an example of "Informed Consent."

Another case of uninformed consent was proven on 11 April 2018 when Nick Cubrilovic notices that Facebook cookies are storing data between log in sessions.  Not only does Facebook track you after clicking the like button, or use the pixel tool, but they are also gathering data from the Messenger App, taking names, phone numbers, photos, and other sources of content.

Shadow profiles are friends’ full address book from their phones, photos and other data sources, hardly informed consent from the 2,700-word data policy.

Nik Cubrilovic first discovered that Facebook was apparently tracking users’ web browsing after they logged off in 2011. That explains why you see ads for products and services you have already been looking at online appear in your Facebook feed.

On 22 May 2018 Mark Zuckerberg appeared before Capitol Hill and 43 times he couldn't answer a question but promised to follow up.  Senator Dianne Feinstein asked him how many fake accounts Facebook has removed.

In addition to gathering data, Facebook polices free speech on their social network with paid intervention providers.

In April 2018 Facebook revealed their anti-terrorism unit.  This is Orwellian, or a political system in which the government tries to control every part of people's lives.  Governments are demanding access and control over users accounts.

The first use of the AI tools was too obtrusive.  On 27 September 2017 one user remarked on the removal of his account based on a newsworthy image.

With regards to the 1972 Vietnamese photo, Facebook complies with foreign governments on what they believe, not what they can prove invalid, but what they call "inaccurate statements".
While Facebook said its policies in Vietnam have not changed, and it has a consistent process for governments to report illegal content, the Vietnamese government was specific. Around 27 October 2017 Facebook revealed that it often complies with U.S. and foreign government requests.  Most request are to remove political activists, but many are activists that may influence  others enough to make economic changes.

During the European Parliament testimonials on 22 May 2018, Facebook was heavily criticized.

On 11 April 2018 Zuckerberg reiterated his power with these governments and control over those users that are determined to be spreading "misinformation."

On top of the data scandal of the largest social network, Cambridge University academic publicly denounced the value of Facebook on 24 April 2018.
There is a huge spectrum of opinion on the value of the Facebook data that Cambridge University academic Aleksandr Kogan gave to Cambridge Analytica's parent company, SCL.
Dr Kogan told a parliamentary committee: "Given what we know now, nothing, literally nothing - the idea that this data is accurate I would say is scientifically ridiculous."
Also, Dr Kogan argues that trying to assess the personality of an individual gives too large a margin of error so the predictions are reliable only if you're taking averages across larger groups. But looking at larger groups may be helpful during an election, when you might be trying to decide where to buy advertising on local radio or where to hold an election rally, for example.

Finally on 19 April 2018  Rolling Stone published an article calling Facebook an Orwellian Surveillance megavillian.  Even their mention of a tossed off hook up site is a parody of their next venture to turn Facebook into a dating application.

Some courts have concluded that the term "interfere" is incapable of being limited to a time, place, and manner restriction and it is, therefore, necessarily overbroad. Either way, AETA violates the First Amendment over breadth doctrine.

This "terrorism" law is violated if one "intentionally damages or causes the loss of any real or personal property (including animals or records) used by an animal enterprise … for the purpose of damaging or interfering with" its operations. If you do that — and note that only "damage to property" but not to humans is required — then you are guilty of "domestic terrorism" under the law.

AETA's failure to define "real or personal property" means that under well settled judicial decisions it includes good will and reduced profits. Under the plain language of the statute, an individual who videotapes or even attempts to videotape the inside of an animal enterprise for the purpose of disclosing the information to the public violates its provisions.

When an undercover activist gained access to a slaughterhouse in 2008 and videotaped footage of cows going into the kill lot so sick that they could not stand, footage which led to the recall of 143 million pounds of meat, the largest in American history, there were concerns over whether the activist would be prosecuted.

(b) PENALTIES.—The punishment for a violation of section (a) or an attempt or conspiracy to violate subsection (a) shall be—

On January 18, 2018 two boys were charged with agricultural animal facilities offences for killing half a million bees at the Wild Hill Honey farm in Sioux City. They face up to 10 years in prison, fines of up to $10,000 and a felony record for life.


RESTITUTION.—An order of restitution under section 3663 of this title with respect to a violation of this section may also include restitution—
(1) for the reasonable cost of repeating any experimentation that was interrupted or invalidated as a result of the offense;
(2) for the loss of food production or farm income reasonably attributable to the offense; and
(3) for any other economic damage, including any losses or costs caused by economic disruption, resulting from the offense.

In conclusion AETA's vagueness creates the appearance of infringement and the threat of prosecution has the potential to silence debate on a wide range of important public issues.  Anyone that supports animal rights activists with the intent to reveal abuse, exploitation, and the torture of animals used as commodities in agribusiness is a domestic terrorist

Revenge Porn

Innocent victims of vengeful lovers are living through a revenge porn nightmare but laws are finally catching up and abusers are being charged.  With the increase in cell phone technology and the popularity of social networking, the explosion of revenge porn has become an alarming social phenomenon.



California Governor Jerry Brown signed into law SB 255, or the "Revenge Porn" bill, on October 1, 2013. The law makes it a crime to post sexually explicit pictures or videos online of another person without his or her permission with the intent to cause emotional distress or to publicly humiliate the victim.

Detectives from the Los Angeles Police Department West Valley Division, Sex Crimes Unit detectives have arrested 32-year-old Sergio Ortiz. He was arrested for 647(j)4 A of the Penal Code - Distribute Private Image of Intimate Body Part(s) of Another. Detectives are asking for the public's help in locating additional individuals who may have been victims of Sergio Ortiz.

Ellie Melaugh is believed to be the first female convicted of targeting a man since so-called revenge porn legislation was introduced a year ago. From April last year UK law made it illegal to share sexually explicit images without the subject's consent. The maximum penalty is two years' jail.

David K. Elam II was charged with stalking, aggravated identity theft, and unauthorized access to the computer of the woman, whom he had met through an online dating service. In 2004, New Jersey passed the nation's first such legislation. The statute makes it a crime for a person who knows "that he is not licensed or privileged to do so" to nonetheless disclose "any photograph, film, videotape, recording or any other reproduction of the image of another person whose intimate parts are exposed or who is engaged in an act of sexual penetration or sexual contact, unless that person has consented to such disclosure."

In 2014, Mary Anne Franks, a University of Miami law professor who has advocated for revenge-porn laws, was repeatedly attacked by online trolls. Goldberg, in a show of support, sent her a lipstick with the name Lady Danger. Franks said "She included a card where she'd written, 'This is what I wear when I want to feel like a warrior.'

Several years ago, Goldberg was harassed by a vengeful ex. At the time, she was working as the director of legal services at the Vera Institute, a criminal-justice nonprofit in Manhattan. The ex threatened to send intimate pictures she'd given him to her professional colleagues. "I stand before you as a lawyer but also as somebody's target," Goldberg said recently, in a speech that she gave at a conference on domestic abuse, in Albany. "When I went to the police, they told me it was not a criminal issue." She'd been frightened and embarrassed, and after the ex was served with a restraining order-he did not disseminate the pictures-she decided to start her own firm. As she put it to me, "That way, I could be the lawyer I'd needed."

The act of posting or distributing nude pictures or videos without the consent of the other party with the intention of humiliating them, ruin their reputation, or to blackmail them is a serious and legal problem affecting children and adults.  Often the shame is too much to bear and sometimes has tragic results, especially for children.  We accept the reality that consenting adults may be reckless to the extent of recording their intimacy for their own pleasure, but it is wrong for one of them to then use that to humiliate or blackmail the other partner.  Everyone, including Catholic priests, could be victims of this cyber crime due to technology.  If you are one of these victims, dish some attitude back, and hold them accountable. Abusers are just one click away from jail.

Taxonomy Vs. Folksonomy

Taxonomies are a consistent way of classifying and describing content and information that allows people to think about information in the same way. This type of system ensures that content is stored and managed in a manner that is consistent with that type of content

On the other hand, folksonomies have no classification restrictions.  They are user generated tags which provide meaning to the users.  The sharing of knowledge is greater since tagging generates communication.  The easier to understand tags also assist search and retrieval of information.
For example social networking hashtags on Twitter and Facebook, and Pinterest photosharing.

Underestimating Online Retail Sales

The Social Science Resource Network (SSRN) posted this article recently on February 7, 2016. 

As the SSRN is an authority source therefore the information is unbiased.  It is important when trying to determine if the online business could be larger than it is reported by the Census Bureau (another authority resource).

The information is written by experts by a private business and the universities of Chicago Law School, University College London, and  Massachusetts Institute of Technology.  It comes from an authority website SSRN and the authors are currently from an educational facility so they highly regarded by peers in the industry. 

The Social Science Resource Network (SSRN) adheres to high standards of the Spanish National Research Council.  Articles are uploaded directly on the website and rated by download popularity.  There are a lot of articles written by experts in their fields.  The website is considered a top authority by the Ranking Web of Repositories, a group belonging to the Spanish National Research Council.

The purpose of the website is to inform of the latest trends in Social Science.  It has articles posted by scientists and educators in their fields.  This article persuades people that online sales are under reported.  It links to my research because it shows that the value in sales for the website may be underestimated.  If the census bureau predicts online sales to rise by 40% by 2020 and the current figures are under-reported in the data then it gives more motivation for new competition.

Spam is generated from email, instant messaging, Usenet newsgroups, web search engines, blogs, wikis, online classified ads, Internet forums fax and more.

CAN-SPAM Act (Controlling the Assault of Non-solicited Pornography and Marketing Act) enacted on January 2004.

By law, all mass mailing must contain:
  • accurate routing information,
  • a subject line that accurately reflects the content of the message, 
  • and an opt-out option to cancel future mailings.
Additionally, by law:
  • the message must be identified as an advertisement,
  • include the sender's valid postal address.

Failure to obey can result in fines up to $11,000.  Under the new law, states are also given the right to enforce much of their own spam legislation.

Facebook Fake, Google Real; Social Networth.

Facebook has a lot of fake profiles on their social network, unlike Google that foresaw that only real profiles have any value.

If you can create as many profiles as you want as whatever you want then you get a lot of false information in your data system.  Advertisers pay to advertise to specific target markets but if those are false profiles then they get no return or sales.   Therefore it doesn't matter how many "likes" a page receives because they do not use real data.   Investors know that without the advertisers the social network can't turn the profit they expected. 

On July 28 2011, Google enforced it's policy to allow only real profiles.   Yay! Google was able to use their foresight to ensure that they have the best quality social network.

In a article a few days ago, a Facebook spokesperson interviewed by the BBC stated,
"All of these companies have access to Facebook's analytics which allow them to see the identities of people who have liked their pages, yet this has not been flagged as an issue." News, 13 July 2012, http://www.bbc.co.uk/news/technology-18813237
LOL.  They have lots of issues besides fake profiles, flawed software and double standards.   One issue I  flagged to the Facebook legal team in July of 2011 regards their double standards for big and small business on their social network.   I requested the removal of private pages using my trademarked brand and the registration of profiles.   Unfortunately they chose to ignore the issue and reiterated to me a bunch of rules from the Help section.   Facebook continues to allow anyone who does not represent my company to use my brand and advertise on their network with my trademark.   Obviously, I would never pay to advertise my brand on their network if there was someone else using my trademarked brand. Yet, there is only one Coca-Cola!?

Unfortunately lots of suckers believed Facebook had the most valuable information on a social network.   Also, the people trying to make money from Facebook's data are going to be disappointed too.   Google on the other hand is steadily increasing in stock market value.  It may have something to do with "like" enforcing principles of "like" integrity and honesty.   :)

Web Site Credibility


Establish your web page credibility by being an authority source that is objective in text.  Use a broad scope and high quality content. Also design an appealing and unique custom site design with functionality to help your success in your e-business.

Authority
The authority of the sites by examination of the whois database, sponsors and who authored the web page content. The author of the sites's sponsor should have the appropriate expertise to present the information authoritatively.

The top-level domain for the country-code TLD is important because some search tools give extra weight to governmental and educational sites.

The highest quality and more authoritative results come from primary sources. A primary source is firsthand information about a particular topic.

Objectivity
Web page information should be fair, the content may contain any subtle or clear biases, or perhaps the information is skewed toward commercial or political interests. Authority sites will use high-quality links to other related sites.

Scope and Quality
The amount of detail provided can help determine the value of a web site. The intended audience also determines the scope of the web site. Additionally, high quality web pages content should be accurate and up-to-date. Compare web pages in the same categories for evaluating web pages.

Design and Functionality
Web pages are designed to attract and hold a viewers attention so that they will spend time interacting and viewing the pages. Most web pages share these common characteristics that make the page more attractive and easier to use.
  • A logo or e-business name on or at the top left corner of the web page
  • Links to related pages, grouped into categories, to make accessing the site's other pages more convenient.
  • Various multimedia, including photos, graphics, animations to interact and attract.
